The State Insurance Regulatory Authority (SIRA) has been forced to issue a Letter of Censure to Insurance Australia Ltd which trades as NRMA Insurance.

The Letter was issued following an investigation by SIRA into complaints by injured persons regarding the delays by the NRMA in responding to requests for treatment and care.

The investigation conducted by SIRA found concerning delays by the NRMA in response to requests for treatment and surgery in 7 separate instances.

The obligation on a CTP insurer, such as NRMA, is clearly provided for in the legislation and guidelines pursuant to which the motor accidents scheme operates. A CTP insurer must determine and respond to an application for a treatment request within 10 days of its receipt.

As a consequence of the NRMA's failure to comply with its statutory obligations, it was issued with 2 show cause notices. The NRMA accepted the determination of SIRA with respect to its failure to comply with its statutory obligations and undertook to implement "appropriate remediation and performance management actions".
