Economic Loss - A Successful Claim

At the time of his motor vehicle accident, our client was 54 years of age. He was rear-ended by a vehicle travelling at approximately 60 km/h. Initially, our client was self-represented. He lodged his own claim form with the insurer for the vehicle at fault. The insurer denied his claim to lump sum compensation, asserting that our client had only suffered minor injuries. Our client then pursued an application for resolution of his dispute. The medical expert appointed to undertake an assessment of our client determined that our client's physical and psychological injuries were minor in nature, thereby precluding our client from recovering any lump sum compensation. The insurer vigorously defended our client's claim by asserting that our client's injuries were pre-existing and that any economic loss suffered was unrelated to the accident.
