Dust Disease - A Successful Claim

Our client was diagnosed with right-sided high-grade mesothelioma. This is an aggressive condition, and our client was given a very poor prognosis. He had worked for many years as a truck driver and waste bin collector. He had not been made aware by any of his former employers as to the likely exposure to asbestos dust or the risks associated with same. Nor was he provided with any protective equipment and no measures to avoid exposure were put in place. We were engaged to prosecute a claim for the contracting of the mesothelioma, in the Dust Disease Tribunal. iCare accepted liability and our client commenced to receive weekly benefits of compensation. There were several defendants in the proceedings being the former employers. Given the urgency of the situation, proceedings were commenced as soon as possible and listed for mediation at the earliest opportunity. The proceedings were successfully resolved for the sum of $875,000. Although the resolution of our client's claim will not alleviate the seriousness of the medical condition from which he suffers, it will provide our client’s family with a level of financial security which is all that our client wanted to achieve. We were humbled by the level of appreciation and gratitude expressed by our client in the handling of his matter and the successful outcome which has given him, and his family, some peace of mind.
