Discrimination In The Course Of Employment

Our Commercial Law Team assisted a client with cerebral palsy in obtaining compensation from his employer, a NDIS provider, due to a constructive dismissal and discrimination. It was alleged by our client that he was forced to resign, a victim of discrimination due to his disability. The allegation, if established, would have clearly infringed the Fair Work Act 2009 (Cth), the Disability Discrimination Act 1992 (Cth) and the Anti-Discrimination Act 1977 (NSW). With supporting evidence that we were able to collate, a letter of demand was sent setting out the legal arguments and representations made on behalf of our client in seeking an appropriate level of compensation for our client’s loss of wages and emotional distress.
