ComCare Claims for Government Employees

The Safety Rehabilitation and Compensation Act 1988, provides for a workers compensation scheme to cover all workers employed by either a Federal agency or pursuant to a Federal award. This has historically included workers employed by organisations such as Telstra, Australia Post, Commonwealth Bank and Linfox. Any workers compensation claim brought under the Safety Rehabilitation and Compensation Act, 1988 are commonly referred to as “Comcare Claim".

Are you eligible to make a claim?

Any person who has been injured during their employment with an employer who comes under the Safety Rehabilitation and Compensation Act 1988, is entitled to make a claim for benefits for any injury sustained. The Comcare Scheme provides for benefits for both physical and psychological injuries which impact upon the ability of a worker to partake fully in their employment duties and/or require medical treatment.

What are you able to claim?

Under the Comcare Scheme, an injured worker is entitled to make a claim for all reasonable and necessary medical and treatment expenses. This would include visits to doctors, specialists, physiotherapists, rehabilitation providers and the like. The injured worker, under the Comcare Scheme, is entitled to recover the cost of any medical aids required including wheelchairs, walking frames, hearing aids and other medical aids that fall under this categrory.

Additionally, an injured worker making a claim under the Comcare Scheme, is entitled to recover benefits (wages) for periods of absence from work. The worker is also entitled to recover make-up pay in the event that the worker is unable to work full-time hours. There are also benefits available to injured workers who suffer a permanent impairment due to an injury, subject to statutory restrictions, and can claim compensation accordingly. Instances where an injured worker can prosecute a common law claim for damages against their employer, under the Comcare Scheme, can also be made where it is established that the injury arose because of the employer’s negligence.

Do I have to pay any legal fees in a ComCare Scheme claim?

Brydens Lawyers will act on your behalf on a “No Win-No Fee” basis. That is, if proceedings are brought on your behalf and, in the unlikely event, they are unsuccessful, then Brydens Lawyers will not raise an invoice. That is, if you do not win your claim, we do not get paid.

In the event that the claim is successful, then the insurer will be called upon to pay a significant proportion of your legal costs as well as any judgment in your favour. The differential between the costs payable by the insurer and the actual costs incurred in the prosecution of the claim is simply adjusted from the judgment sum.
